These Terms & Conditions govern your use of the EverPeak AI website, forms, chat widget, booking pages, audit purchase pages, and services. By using our website, submitting a form, booking a call, purchasing an audit, or working with EverPeak AI, you agree to these Terms.

1. Services

EverPeak AI provides AI-powered communication, lead response, booking workflow, missed inquiry, missed-call response, and follow-up support for appointment-based businesses.

Services may include:

AI Booking & Lead Response Audits;

website lead-flow reviews;

booking path reviews;

missed inquiry and missed-call risk reviews;

workflow recommendations;

optional AI chat, missed-call text-back, AI receptionist, CRM, pipeline, and automation setup services.

2. $149 AI Booking & Lead Response Audit

The $149 AI Booking & Lead Response Audit is a one-time review and recommendation service.

The audit may review:

website lead flow;

booking path;

contact forms;

missed inquiry risk;

missed-call risk;

follow-up gaps;

whether AI chat, missed-call text-back, AI receptionist, or booking automation may fit the business.

The audit does not include full implementation, software setup, AI agent buildout, CRM configuration, phone setup, SMS setup, missed-call text-back setup, or ongoing management unless separately agreed in writing.

3. Optional Setup Services

After an audit or consultation, EverPeak AI may recommend optional setup services.

Starting setup options may include:

Missed Call Text-Back Recovery: from $497 setup + $197/month;

AI Receptionist & Booking Support: from $997 setup + $497/month.

Final pricing depends on business needs, communication channels, integrations, software requirements, usage, and scope.

SMS, voice, AI, phone, platform, carrier, messaging, and third-party usage fees may be billed separately.

4. No Guarantee of Results

EverPeak AI does not guarantee revenue, profit, booked appointments, consultations, lead volume, conversion rate, search rankings, ad performance, or that every visitor, caller, or lead will be captured.

Our services are designed to improve systems, response speed, lead capture, booking flow, and follow-up processes. Business results depend on many factors outside our control, including offer, pricing, market demand, staff behavior, website traffic, reputation, sales process, compliance, and customer response.

5. Not Medical, Legal, Financial, or Compliance Advice

EverPeak AI provides business automation and workflow support. We do not provide medical, legal, financial, tax, healthcare, HIPAA, or regulatory compliance advice.

Our website, chat, and forms are not intended for medical questions, patient intake, diagnosis, treatment advice, emergencies, or protected health information.

You are responsible for consulting qualified professionals regarding legal, medical, healthcare, privacy, messaging, SMS, telemarketing, and compliance obligations applicable to your business.

6. Client Responsibilities

You agree to provide accurate, complete, and timely information needed to perform the audit or services.

You are responsible for:

ensuring you have rights to use any business information, website, phone number, CRM, calendar, account, or content you provide;

reviewing recommendations before implementation;

maintaining your own licenses, accounts, logins, billing, and third-party subscriptions unless otherwise agreed;

obtaining required consent from your customers or leads;

complying with applicable laws, regulations, platform rules, carrier rules, and industry requirements;

not submitting medical, patient, confidential, or sensitive information through our public website or chat.

7. Phone, SMS, and Messaging

Phone and SMS automation may require proper phone number setup, business registration, A2P/10DLC registration, carrier approval, opt-in language, opt-out handling, privacy disclosures, and other compliance steps.

EverPeak AI does not guarantee approval by carriers, messaging providers, software platforms, or third-party vendors.

SMS consent must be properly collected where required. Message and data rates may apply. Recipients must be able to opt out where required.

8. Payments

Payment is due at the time of purchase unless otherwise agreed in writing.

For the $149 AI Booking & Lead Response Audit, payment covers the audit review and recommendation process only.

Third-party payment processors may handle payment transactions. EverPeak AI is not responsible for payment processor errors, outages, declined payments, chargebacks, or third-party payment terms.

9. Refunds and Cancellations

For one-time audit purchases, you may request cancellation before work has started. Once audit work has begun or the audit has been delivered, the audit fee is non-refundable unless required by law.

For setup or ongoing services, refund, cancellation, and termination terms may be stated in a separate agreement, invoice, proposal, or subscription arrangement.

10. Scheduling and Calls

If you book a setup call, audit call, or consultation, you agree to attend at the scheduled time or reschedule in advance when possible.

EverPeak AI may reschedule calls due to availability, technical issues, or business needs.

11. Third-Party Tools and Platforms

EverPeak AI may use or recommend third-party platforms, including CRM, website, calendar, chat, AI, automation, email, phone, SMS, payment, analytics, or communication tools.

Third-party tools are governed by their own terms, pricing, privacy policies, uptime, support, and limitations. EverPeak AI is not responsible for third-party outages, pricing changes, approval delays, platform restrictions, or service interruptions.

12. Intellectual Property

EverPeak AI owns its website content, service structure, audit framework, workflows, templates, prompts, copy, processes, designs, and business materials unless otherwise stated.

You may not copy, resell, reproduce, distribute, or commercially exploit EverPeak AI materials without written permission.

You retain ownership of your own business name, logo, website, data, and materials you provide.

13. Confidentiality

EverPeak AI will use reasonable care with business information you provide for an audit or service. However, do not submit medical, patient, highly sensitive, confidential, or regulated information through public forms, website chat, or unsecured channels.

14. Website and Chat Use

You agree not to misuse the website, forms, chat widget, booking pages, or services. You may not use them to submit spam, malware, false information, unlawful content, abusive messages, or unauthorized data.

We may restrict access, block users, or refuse service if we believe our website, systems, team, or users are being abused.

15. Limitation of Liability

To the maximum extent permitted by law, EverPeak Systems LLC, doing business as EverPeak AI, will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from use of the website, audit, recommendations, third-party tools, or services.

To the maximum extent permitted by law, our total liability for any claim related to a paid audit or service will not exceed the amount you paid to EverPeak AI for the specific service giving rise to the claim.

16. Indemnification

You agree to indemnify and hold harmless EverPeak Systems LLC, its owners, contractors, service providers, and representatives from claims, damages, liabilities, costs, or expenses arising from your misuse of the website or services, your violation of these Terms, your violation of applicable law, or your use of our recommendations in your business.

17. No Unlawful or Prohibited Use

You may not use EverPeak AI services for unlawful, deceptive, abusive, spam, or non-compliant messaging, calling, advertising, data collection, or automation practices.

18. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Your continued use of the website or services after updates means you accept the revised Terms.

19. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
